What To Consider When Choosing A Lawyer

It’s not always a good day when you have to call up a law office- in fact, it’s almost always a pain. - Each state has a bar that licenses attorneys that practice before its courts. This means that even though an attorney may hold a valid license, this simple fact in itself does not necessarily mean that they are sufficiently competent to handle a certain type of case since their preparation, background and practice, may not warrant their retention for it.
- Lawyers need to take oaths to take any types of cases that are sufficiently familiar and competent to handle. It goes without saying that on occasion, such oaths may have little meaning to some people. Even if recourse is available through such subsequent actions like a legal malpractice action upon findings of negligence, to find an attorney willing to take on a legal malpractice action as well as to undergo such a proceeding in general is at best lengthy and tiresome.
- When evaluating a lawyer, there are many steps that you can take to reasonably assure yourself of hiring a competent lawyer. A good reference point is the bar that licenses them by requesting a record of any actions that may affect their eligibility to practice law (or disciplinary actions).Although requesting a membership record from the state bar isn’t at all a guarantee, it, at least, establishes a history and hopefully one that is free and clear of any negative remarks. Any record of actions that might affect a lawyer’s eligibility to practice law should be taken into consideration prior to their retention for legal services.
- Additionally, certain state bars have designations for those superior lawyers that have demonstrated through testing as “specialists.” This should definitely be taken into consideration when evaluating lawyers, according to the type of case one needs legal representation for. Designation as a specialist, is also never a 100% guarantee that results will be favorable, but if a state bar designates an attorney as a specialist, at least said person is someone who not only passed the bar and obtained a license to practice law, but additionally passed another exam for a particular field of law and was designated by the bar as a “specialist.”
Aside from these extremely important factors you must consider in choosing a lawyer, it would be wise to consider a bar certified lawyer referral service to help you in the evaluation process, by obtaining a referral to a lawyer recommended by them. This takes a lot of the evaluation work out of evaluating since certified lawyer referral services have criteria that must be met for the service to refer said lawyer to potential clients. Prior to accepting a referral, a suggestion may be to ask the certified referral service what that criteria is.
